What is relational contracting?

Relational contracting is a cutting edge movement in the legal field and a style of legal drafting that puts people, purpose, and peace first, and legalese second. And also saves you time and money…

This approach (1) asks the parties to discover and co-create the agreement developing between them rather than imposing an adversarial-style legal template on the relationship; (2) by focusing on the process, encourages the relationship to thrive during times of change and disagreement such that it contributes to the overall health and wellbeing of the parties and the community at large; and (3) saves time and money in avoiding ill-fitting relationships and preventing litigation.

It does this in a few ways:

  • We spend more time upfront working together to describe the broader purpose of the relationship (what is the more beautiful world our hearts know is possible?), and how the particular business project contributes to this shared purpose.
  • We agree upon a set of values for how the parties expect to treat each other throughout.
  • We recognize that change is constant and disagreements can be productive, and not every scenario can or should be described in the agreement.
  • We instead include a process for turning toward change and disagreement in a generative, peaceful process called a Peace Pact.
  • We write the agreements in plain language that anyone can understand.
  • We include all the important legal terms necessary to protect everyone’s legal interests and manage legal risk.

Who is best suited for relational contracting?

  • Anyone who is interested in being in a relationship that centers fairness, honesty, accountability, collaboration, and peace.  
  • Anyone who recognizes the importance of “right relationship” and its contribution to health and wellbeing of the human and more-than-human world alike.  
  • This process is especially well-suited for purpose-driven people and companies who feel that the work they do in the world is about more than simply earning profits and are willing to put in the effort to create a living agreement that makes them proud and interconnected.  
  • Relational contracting is a radical and effective tool for finding and maintaining harmony in any relationship – business, personal, professional, or romantic.
